EVENTBEE PRIVACY POLICY & ATTENDEE TERMS

Eventbee ("we," "us," or "our") respects the privacy of anyone who uses an Eventbee website and Eventbee online software. We gather important information from our visitors and customers. We publish this Privacy Policy to communicate how we gather and use information about you, how we protect it, and how you can participate in its protection.

Eventbee provides its service to you subject to the Eventbee Terms of Service and this Privacy Policy, which shall be deemed an inseparable part of the Terms of Service. We reserve the right to modify or update this Privacy Policy at any time. Any changes will become effective immediately upon posting the revised policy to our website. Your continued use of the platform or services after an update is posted constitutes your absolute acceptance of the revised terms.


Section 1: Real-Time Tracking, Notice, and Explicit Consent

1.1 Real-Time Tracking and Monitoring Notice. We utilize automated digital tracking technologies, including cookies, web beacons, tracking pixels, automated scripts, analytics tools, and session replay utilities (collectively, "Tracking Technologies") to monitor, record, and optimize how you interact with our website and our software platform.

1.2 Your Explicit, Prior Consent. By accessing our platform, registering for an event, or interacting with any page or ticketing asset hosted by us, you acknowledge and provide your explicit, unambiguous, and prior consent to the real-time interception, recording, transcription, duplication, and transmission of your digital interactions, clicks, form inputs, text entries, keystrokes, and electronic identifiers (including your IP address) to Eventbee and our third-party infrastructure, analytics, and software-as-a-service providers. If you do not consent to this real-time monitoring and recording, you must adjust your browser or cookie settings or immediately cease using any event pages hosted on our network.


2.1 Personal Information Requested. We require people who register to use Eventbee online software (the "Services") to give us contact information. Depending on the services chosen, we ask for contact and account information, such as name, company name, address, phone number, e-mail address, and password, in addition to financial and billing information, such as billing name, address, and credit card number. When you express interest in additional information, when you register for the Services, or after you become a user, we may ask for additional personal information, such as title, mobile number, fax number, or additional company information, such as annual revenues, number of employees, or industry. You can opt out of providing additional information by not entering it when asked. Eventbee does not distribute or share customer e-mail addresses, except as noted in its Terms of Service, or as may be required by law.

2.2 Internal Use of Information. Eventbee uses the information we collect to set up the Services for individuals and their organizations. We may also use the information to contact customers and prospects to further discuss their interest in our company, the Services we provide, and ways we can improve them, and to send information such as announcements of promotions and events regarding our company or partners. We may also e-mail a customer newsletter and updates about the Services or the company. You can opt out of receiving these communications by replying to them at the time they are distributed or at any time by e-mailing us.

2.3 Financial and Billing Data Usage. All financial and billing information that we collect through an Eventbee website and the Services is used solely to bill for the Services. Eventbee does not use this billing information for marketing or promotional purposes. Except as we explicitly state at the time we request information, or as provided for in the Eventbee Terms of Service, we do not disclose to any third party the information provided.

2.4 IP Addresses and Diagnostics. Eventbee may also collect certain information from visitors to an Eventbee website and customers of the Services, such as Internet addresses. This information is logged to help diagnose technical problems and to administer the Eventbee website and Services in order to constantly improve quality. We may also track and analyze non-identifying and aggregate usage and volume statistical information from visitors and customers and provide such information to third parties.


Section 3: Third-Party Relationships & Shared Data

3.1 Referral Partners. Eventbee has referral relationships with third-party companies and individuals ("Referral Partners") who refer their customers to Eventbee. Customers who become paying users of Eventbee online software through a Referral Partner are considered customers of both Eventbee and the Referral Partner. Eventbee and a Referral Partner may share customer contact as well as account, financial, and billing information with respect to their joint business relationship with the customer. The sharing of this information allows Eventbee and the Referral Partner to establish the identity of the shared customer and determine referral fees owed. This sharing also allows Referral Partners to provide consolidated billing services to the shared customer. Shared contact, account, financial, and billing information is governed by the Eventbee Terms of Service. Eventbee does not share your raw event or business data with Referral Partners.

3.2 Integration Partners. Eventbee has integration relationships with third-party companies and individuals ("Partners"). These relationships extend the functionality of the Services and the Integration Partner application or service ("Integrated Service") by allowing the Services and the Integrated Service to exchange customer data and to establish linked business processes between the two. Customers who pay Eventbee for use of the Services and use this Integrated Service are considered customers of both Eventbee and the Partner. Eventbee and the Partner may share customer contact, account, financial and billing information, and business data with respect to their integrated business relationship with the customer. The sharing of this information allows Eventbee and the Partner to establish the identity of the shared customer and determine referral fees owed, allows the Partner to provide consolidated billing services to the shared customer, and allows for the enhanced functionality of the integrated service. Shared contact, account, financial and billing information, and business data is governed by the Eventbee Terms of Service.

3.3 Credit Card Processing Intermediary. Eventbee uses a third-party intermediary to manage credit card processing for platform subscription fees. This intermediary is solely a link in the distribution chain and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Eventbee does not store customer credit card information on its servers. Other third parties, such as content providers, may provide information on an Eventbee website, but they are not permitted to collect any information, nor does Eventbee share any personally identifiable user information with these parties.

3.4 Social Media Connections (e.g., Facebook). You can connect your Eventbee account to your accounts on third-party services like Facebook, in which case we may collect, use, disclose, transfer, and store/retain information relating to your account with such third-party services in accordance with this Privacy Policy. For example, if you connect with Facebook, we store your Facebook ID, first name, last name, and email, and use them to connect with your Facebook account to provide certain functionality on the services, like recommending events that your Facebook friends are interested in.


Section 4: Data Ownership & Event Manager Responsibilities

4.1 Eventbee as a Data Processor. Eventbee customers (Event Managers) use Eventbee online software to host data and information. Eventbee will not review, share, distribute, print, or reference any such data except as provided in the Eventbee Terms of Service, or as may be required by law. We will view or access individual records only with your permission (for example, to resolve a problem or support issue). Users of the Services are responsible for maintaining the confidentiality and security of their user registration and passwords.

4.2 Event Manager Pixels and Tracking. Certain public-facing event pages hosted on our network contain tracking pixels, marketing tags, or custom analytics scripts (including but not limited to Meta/Facebook Pixels and Google Analytics) deployed independently by the Event Manager hosting that specific event. These third-party tracking tools are controlled entirely by the Event Manager. Eventbee does not access, own, or control the data transmitted through these Event Manager-installed tracking utilities. We are not responsible for the privacy or tracking practices of these independent Event Managers.


Section 5: Independent Relationship & Ticket Purchase Refund Policy

5.1 Connected Payment Gateways & Ticket Funds. When an attendee purchases a ticket or registers for an event on this platform, the payment is processed directly by the independent Event Manager using their own connected third-party payment processor account (such as their independent Stripe or PayPal account). Eventbee does not receive, hold, process, distribute, or store attendee credit card data, bank information, or event ticket purchase funds.

5.2 Total Exclusion of Eventbee from Financial Disputes. All ticket sales, registrations, and monetary transactions are strictly between the Attendee and the Event Manager. Because Eventbee does not hold your funds and has no access to the Event Manager’s private merchant gateway, it is physically and legally impossible for Eventbee to issue ticket refunds, reverse bank charges, or intervene in payment disputes. Eventbee is not a party to the financial transaction and will not participate, arbitrate, or involve itself in any dispute resolutions, customer service claims, or chargeback management between attendees and Event Managers. Any and all inquiries regarding ticket refunds, event cancellations, venue changes, or event quality must be addressed directly to the Event Manager.


Section 6: Cookies & Third-Party Site Links

6.1 Cookies. Cookies are files Web browsers place on a computer's hard drive. They are used to help us authenticate clients and provide timesaving shortcuts and preferences. Eventbee uses a persistent encrypted cookie, if the client requests, to save and retrieve individual authentication information as well as other per-client device preferences. When a visitor follows a link to the Eventbee website from an affiliate or promotion, Eventbee stores information about that affiliate or promotion in a session cookie. Acceptance of these cookies is optional. Eventbee issues a mandatory session cookie to each user of the Services only to record encrypted authentication information for the duration of a specific session. If you reject this cookie, access to and usage of the Services will be denied.

6.2 Third-Party Sites. The Eventbee website and online applications contain links to other websites. Eventbee is not responsible for the privacy practices or the content of these other websites. Customers and visitors must check the policy statement of these other websites to understand their policies. Customers and visitors who access a linked site may be disclosing their private information. It is your responsibility to keep such information private and confidential.


Section 7: Attendee Dispute Resolution, Forum Selection, and Class-Action Waiver

To the maximum extent permitted by law, if any user or attendee attempts to file any claim, dispute, or lawsuit directly against Eventbee (the platform provider) arising out of or relating to data collection, tracking pixels, or an event transaction facilitated by the platform, they explicitly agree to the following strict conditions:

  • Mandatory 60-Day Pre-Dispute Notice Period: Before initiating any formal legal action or lawsuit against Eventbee, you must send a physical, written, and dated description of your claim via certified mail to Eventbee’s Registered Agent on file with the Texas Secretary of State. This notice must contain your full legal name, account/registration details, a factual overview of the issue, and the exact remedy sought. Eventbee shall have sixty (60) calendar days from receipt to evaluate and attempt to resolve the issue informally before you may file any formal legal action.

  • Mandatory Forum Selection Clause: Any permitted lawsuit or legal action filed by a user or attendee against Eventbee must be brought exclusively in the state courts located in Williamson County, Texas, or the United States District Court for the Western District of Texas (Austin Division). You irrevocably consent to the personal jurisdiction of these courts and waive any claim that Williamson County, Texas is an inconvenient or improper forum (forum non conveniens).

  • Governing Law: This Privacy Policy, along with any permitted disputes or claims, shall be governed by, interpreted, and enforced in all respects in accordance with the laws of the State of Delaware, without regard to its choice of law principles.

  • Class Action Waiver: You agree that any claim brought against Eventbee must be pursued solely on an individual basis. You explicitly and irrevocably waive the right to participate as a class member, class representative, or private attorney general in any class-action lawsuit or consolidated proceeding against Eventbee.


Section 8: Security & Contact Information

We employ industry-standard data encryption and technical security protocols to protect the information flowing through our system infrastructure. However, no digital transmission or data storage system can be guaranteed 100% secure.
